Y'know, I like to think that shit like this is the death rattle of a failed ideology, but it never really goes away. It just hibernates, like locusts, and then emerges every generation, to much the same effect. On the bright side, it could always be worse.

I'm getting a little fed up here with these post titles saying this or that terrible thing will happen when nothing of the sort is true.
This seems to be just a proposed amendment to an appropriations bill. The name at the top is "CHRIS CARPENTER, LEGISLATIVE INTERN".

Could you please dig up some actual news item backing up your claim that "Arizona to Criminalize Passive Resistance"?

I agree that these post titles and news headlines are misleading. But I still think that they should be reported on because they could potentially become huge issues. They just should be reported on with that in mind.

Sure it should be reported on if it ever appears to actually have a chance on becoming law. This appears to be just something somebody on the AZ Senate appropriations committee just decided to look into. It's certainly not news that the AZ Senate seems to be heavily influenced by screw heads and troglodytes.

Better, but I'd still like to see something more substantive than a snippet of speculation on Daily KOS. Really there's nothing here.
And it bears mentioning that even if this was an actual thing, it's a thing which would be constitutionally DOA. State legislatures no doubt cook up a dozen crazy schemes a week (probably a day in AZ), with barely any even seeing the light of day.

I'm not sure "constitutionally DOA" is a thing. Surely if an unconstitutional law is passed, there isn't any magic that makes it not a law "on arrival"- does it not retain the force of law until a successful court challenge has finally managed to strike it from the books?

Technically you are correct, but a court challenge and constitutional smackdown can occur even within hours of a law's passage. At the very least the law could be immediately temporarily barred from enforcement pending an official ruling.

BROWN BAG TESTING TO BEGIN IN AZ SCHOOLS THIS THORSDAY.

In a nod to the Norse population of Arizona brown bag testing will be mandated for entry into schools this Thors-day.
Any child found to have skin darker than a paper bag (Trader Joe's post consumer content paper grocery bag) will be refused access to education or any other form of information excepting Fox News.

In a surprising turn around, the State Capitol Chapter of Angry White People for Undeserved Advantages had this to say:

"Arizona is a very sunny state and the lack of an allowance for tanning is quite disturbing. If the the guards at the door are too concerned about controlling their own sexual impulses to check the skin color inside the bathing-suit area then we should institute a freeze on this law until such time as a sufficient number of eunuchs can be procured from France, or a similarly ball-less white nation."

It is considered unlikely that anything will keep this law from happening and that starting this Thorsday huge tribes of beautifully (but unfortunately) tanned white children will be denied access to information about the world "outside" Arizona.

A spokesman for Arizona's goth population had this to say:

"We're both in favor of this as it stands right now."

The basic idea is that if everyone who is charged with a crime refused to plea bargain and demanded a jury trial the legal system would grind to a halt.

There is no anticipated fiscal impact to the state General Fund associated with this legislation; however, there may be costs associated with increased prosecution and incarceration.

So, "costs" don't represent a "financial impact"? Nice.
Of course, there's no way that criminalizing passive resistance could possibly result in active resistance. Perish the thought. Even if it did, no doubt the General Fund would be entirely unimpacted, right?

"Passive resistance" still equals "resisting arrest"

"Passive resistance" does not equal "non-violent disobedience..."
